United States of America v. Daniel M. Lavalley

February 9, 2012

UNITED STATES OF AMERICA, PLAINTIFF
v.
DANIEL M. LAVALLEY, DEFENDANT

The opinion of the court was delivered by: Chief Judge Steven J. McAuliffe

ORDER

Defendant Lavalley's Assented-to Motion to Continue the final pretrial conference and trial for at least forty-five (45) days is granted (document no. 12).

Trial has been rescheduled for the month of April 2012. Defendant Lavalley shall file a waiver of speedy trial rights not later than February 21, 2012. On the filing of such waiver, his continuance shall be effective.

The Court finds that the ends of justice served by granting a continuance outweigh the best interest of the public and the defendant in a speedy trial, 18 U.S.C. § 3161(h)(8)(B)(iv), in that failure to grant a continuance would unreasonably deny the defendant the reasonable time necessary for effective preparation taking into account the exercise of due diligence under the circumstances.

Final Pretrial Conference is rescheduled for April 4, 2012 at 9:30 a.m.

Jury selection will take place on April 17, 2012 at 9:30 a.m.

SO ORDERED.
